STM-Diving / STM-Travel – Ltd

1. Scope
These General Terms and Conditions of Sale (GTC) apply to all cruise and diving safari bookings organized by STM-Diving / STM-Travel – Ltd, made via the online store, by email, or any other booking channel. By booking a trip, the customer acknowledges that they have read, understood, and accepted without reservation these GTC, the payment terms, and the privacy policy.
2. Reservation and payment
1. The reservation constitutes a binding offer on the part of the customer.
2. The contract is deemed to have been concluded only after written confirmation by STM-Diving / STM-Travel – Ltd and receipt of payment in accordance with the terms and conditions below:
– Credit card: immediate payment of the total amount.
– Bank transfer:
– 20% deposit upon order,
– 30% no later than 60 days before departure,
– Balance 7 days before departure or upon boarding (if agreed in advance).
3. In the event of non-payment within the specified time frame, STM-Diving / STM-Travel – Ltd reserves the right to cancel the reservation and apply the applicable cancellation fees.
3. Cancellation terms and conditions
1. All cancellations must be made in writing (by email).
2. Fees will be retained as follows:
– 10% if cancellation occurs 150 days before departure,
– 20% if cancellation occurs 100 days before departure,
– 50% if cancellation occurs 50 days prior to departure.
3. No refund will be made in the event of cancellation less than 50 days before departure.
4. Diving requirements
– Participants must be certified (Open Water, Advanced, Level 1 or 2, etc.) according to the specific requirements of each cruise.
– Before the cruise begins, they must provide their certification and logbook.
– Failure to follow safety instructions, physical unfitness, or any dangerous behavior may result in exclusion from diving without refund.
– Compliance with safety rules takes precedence over all other considerations.
5. Disclaimer of liability
Diving involves risks. Customers participate in full knowledge of this and release STM-Diving / STM-Travel – Ltd, its employees and partners from any liability in the event of an accident, incident or damage occurring during the cruise or diving activities.
Each customer must have adequate personal insurance coverage. In the absence of such coverage, STM-Diving will not be responsible for medical, evacuation, or treatment expenses.
6. Delays and navigation conditions
– STM-Diving is not responsible for delays related to customer transportation or force majeure affecting their arrival or return.

– In the event that the scheduled vessel is unavailable, another vessel with similar characteristics will be offered at no extra cost.
– The Egyptian coast guard may delay the departure of the cruise for various reasons (weather, inspections, etc.). STM-Diving is in no way responsible for this. Accommodation will nevertheless be provided.
7. In case of accident
Staff are authorized to pass on useful information (medical information, equipment used, etc.) to the emergency services to facilitate treatment. STM-Diving cannot be held responsible for any equipment passed on to the authorities in such cases.
8. Force majeure
In the event of force majeure (epidemic, disaster, government decision, etc.), STM-Diving may cancel the cruise without compensation. The amounts paid may be refunded or transferred to another date.
9. Image rights
Photos/videos may be taken during cruises. Participants agree that these images may be used for promotional purposes (website, social media, brochures).
Any refusal must be notified in writing prior to departure. Consent may be withdrawn at any time.
10. Confidentiality and data protection
STM-Diving / STM-Travel – Ltd is committed to protecting customers’ personal data:
– Purpose: managing reservations, communication, promotion (with consent).
– Data processed: name, address, email address, travel and payment information.

– Customer rights: access, rectification, deletion, opposition, portability.
– Security: technical and organizational measures implemented to prevent unauthorized access.

11. STM-Diving / STM-Travel Ltd accepts no liability for:
– Loss or damage to the customer’s personal property
– Injuries or accidents occurring during the trip, except in cases of gross negligence or wilful misconduct on the part of the company
– Services provided by third parties that are not included in the contract
It is strongly recommended that you take out comprehensive travel and diving insurance.
12. Disputes and competent jurisdiction
Any dispute relating to the performance or interpretation of these T&Cs shall first be submitted to an attempt at amicable resolution.
Failing this, the competent jurisdiction shall be the courts of London (United Kingdom).
The T&Cs are governed by UK law (England and Wales).
